Sysmex Social Media Acceptable Use Policy

Sysmex Corporation (“Sysmex”) establishes the following Sysmex Social Media Acceptable Use Policy (“AUP”).

Scope

This AUP applies to all Users when browsing, using or otherwise accessing any social media platform operated by Sysmex (“Sysmex Social Media”). Your use or access of any Sysmex Social Media shall be deemed to constitute your agreement to observe and comply with the AUP when engaging in any such browse, use or access.

Hours of Operation

The hours during which Sysmex may post any information or reply via any Sysmex Social Media are, in principle, between 9:30 and 17:00 JST (excluding Saturdays, Sundays, Japanese national holidays, seasonal vacations, and year-end and New Year holidays).
However, Sysmex may operate Sysmex Social Media outside of these hours.

Replies

Sysmex does not undertake that it will reply to all comments and posts made via any Sysmex Social Media.

Exclusion of Liability and Other Terms

  1. 1Sysmex shall not be liable for the accuracy, safety, usefulness, or legitimacy of any information on any Sysmex Social Media.
  2. 2Sysmex shall not be liable for any content posted by Users.
  3. 3Sysmex shall not be liable for any accounts operating under the same names as Sysmex Social Media accounts.
  4. 4Sysmex may not be held responsible for any remarks made by individuals impersonating Sysmex within Sysmex Social Media accounts.
  5. 5Sysmex shall not be liable for any damages incurred by Users arising from their use of, or inability to use, Sysmex Social Media.
  6. 6Sysmex shall not be liable for any damages incurred by Users or third parties arising from disputes between Users, or between Users and third parties.
  7. 7 In addition to items 1 through 6 above, Sysmex shall not be liable for any damages incurred by Users or third parties in connection with Sysmex Social Media.
  8. 8Copyrights , moral rights, and other related rights of posted content belong to the respective authors. However, by posting content, authors are deemed to have granted Sysmex a royalty-free, non-exclusive license to use (including copying, adapting, excerpting, and publishing) such content, both in Japan and overseas, and to have agreed not to exercise their copyrights, moral rights or other related rights against Sysmex.
  9. 9The copyrights, moral rights, and other related rights of content posted by Sysmex belong to Sysmex or to third parties holding legitimate rights. The posting of such content does not grant Users any rights to use it (including copying, adapting, excerpting, or publishing).
  10. 10When collecting personal information from Users, Sysmex handles such information appropriately in accordance with its privacy policy.
  11. 11Sysmex may delete content or suspend publication on Sysmex Social Media accounts without prior notice.
  12. 12 Sysmex may amend this policy without prior notice.

Prohibited Acts

The following acts are prohibited when using any Sysmex Social Media.
If any User is found to have committed any of the following acts, without limitation, the post(s) concerned may be deleted and/or the relevant account(s) may be blocked and such other action taken as Sysmex, in its sole discretion, may determine.
If a User causes damages or other harm to a third party through their use of Sysmex Social Media, the User shall be responsible for resolving such matters at their own liability and expense.

  1. 1Identifying, disclosing, or divulging any personal information of another User or a third party without their consent.
  2. 2Damaging Sysmex, another User, or a third party.
  3. 3Impersonating Sysmex, another User, or a third party.
  4. 4Slandering, disparaging, defaming, or adversely affecting the reputation of Sysmex, another User, or a third party.
  5. 5Infringing a copyright, trademark right, or other rights of Sysmex, another User, or a third party.
  6. 6Posting any information that is not relevant to Sysmex Social Media in question.
  7. 7Conflicting with public policy or providing information that is in conflict with public policy.
  8. 8Breaching the acceptable use policy of another social media platform.
  9. 9Any other act that is deemed by Sysmex to be inappropriate.

Relevant Laws and Jurisdiction

The AUP shall be governed by and construed in accordance with the laws of Japan. In the event of a dispute between a User and Sysmex, the Osaka District Court shall have exclusive jurisdiction as the court of first instance.
